Terms of Service
General terms and conditions for use of the Ticpan platform
1. Parties
This document governs the contractual relationship between Ticpan, hereinafter "the Provider", and the user who accepts these terms during the registration process, hereinafter "the Customer".
The Provider operates the service under the domain ticpan.app. For any legal enquiry please contact hola@ticpan.app.
2. Service description
Ticpan is a SaaS platform for monitoring and analysing the technical health of Magento stores. The service includes automated evaluation of rules distributed across pillars: Security, Performance, Technical SEO, Code Quality and Infrastructure, as well as the generation of a periodic Health Score.
The Customer installs a free, open-source agent module (way2ecommerce/ticpan-agent)
on their Magento installation. The module collects technical metrics and sends them encrypted to the platform.
3. Access and registration
Using the service requires creating an account with a valid email address and a secure password. The Customer is responsible for keeping their credentials confidential and for all actions carried out under their account.
The Provider reserves the right to suspend or cancel accounts that breach these terms, contain false information, or are used in an abusive or fraudulent manner.
4. Plans and billing
The service is offered under several monthly subscription plans (Free and Pro). Prices published on the website exclude VAT, which will be applied in accordance with applicable law.
- Subscriptions renew automatically at the start of each period.
- The Customer may cancel at any time from their dashboard; access remains active until the end of the paid period.
- No refunds are issued for partial periods, except where required by law.
- The Provider may modify prices with 30 days' advance notice by email.
5. Acceptable use
The Customer agrees to:
- Use the service solely to monitor Magento installations under their control or authorisation.
- Not attempt to access other customers' data or the Provider's infrastructure.
- Not reverse-engineer the agent module or the platform.
- Not use the service for illegal activities or activities that infringe third-party rights.
6. Availability and service levels
The Provider commits to maintaining reasonable platform availability, targeting 99.5% monthly uptime. Scheduled maintenance windows will be communicated in advance.
The service is provided "as is". The Provider does not warrant that it will be uninterrupted, error-free, or that the results obtained will be completely accurate at all times.
7. Data privacy
The agent module is designed not to access sensitive business data (orders, customers, transactions) without the Customer's explicit consent. The processing of personal data is detailed in the Privacy Policy.
8. Intellectual property
The Ticpan platform, its design, source code (excluding the open-source agent module) and content are the property of the Provider. Reproduction or distribution without express authorisation is prohibited.
The agent module is distributed under the MIT licence. The Customer may use, modify and redistribute it in accordance with the terms of that licence.
9. Limitation of liability
In no event shall the Provider be liable for indirect damages, lost profits or data loss arising from the use or inability to use the service, beyond what applicable law requires. The Provider's total liability shall not exceed the amount paid by the Customer in the three months preceding the event giving rise to the claim.
10. Modifications
The Provider may update these terms. Material changes will be communicated by email with at least 15 days' notice. Continued use of the service after the notification constitutes acceptance of the new terms.
11. Governing law and jurisdiction
This agreement is governed by Spanish law. For the resolution of disputes, the parties submit to the Courts and Tribunals of Alicante, expressly waiving any other jurisdiction.
